General Terms and Conditions of Use (GTCU)

GENERAL CONDITIONS OF USE OF THE OBJOW PLATFORM BY USING THE "OBJOW" PLATFORM: - YOU ACKNOWLEDGE THAT YOU HAVE READ AND ACCEPT ALL OF THE PROVISIONS OF THESE GENERAL CONDITIONS OF USE; - YOU ACKNOWLEDGE THAT YOU HAVE READ AND ACCEPT THE OBJOW PRIVACY POLICY; - YOU AGREE TO BE BOUND BY ALL OF THESE PROVISIONS; - YOU AGREE TO COMPLY WITH THEM.

Article 1 - General information

1.1 These general conditions of use (hereinafter the "GCU") apply without restriction or reservation to the use of the "OBJOW" platform available at the following address:

https://app.objow.com (hereinafter the "Platform") by any individual with a subscription or access to the platform (hereinafter the "Users"), whether they are an Administrator, Manager or Collaborator.

1.2 The Platform is offered by OBJOW, a simplified joint stock company with capital of €31,400, whose registered office is at 36 rue Victor Grignard - 42000 SAINT ETIENNE, registered in the SAINT ETIENNE company register under number 852 715 887, Code APE 7022Z and whose Intracommunity VAT number is FR41852715887 (hereinafter "OBJOW").

1.3 The Service Provider reserves the right to modify these GTU at any time and without notice, by publishing the new version on the Platform or on its website, available at the following address: https://www.objow.com/conditions-generales-dutilisations-objow. The User must consult these GCU on a regular basis.

1.4 The User acknowledges that browsing the Platform, even without using the Services, implies unreserved acceptance of these GCU.

Article 2 - Definitions

"Connector": refers to an application programming interface enabling the exchange and processing of data between the Platform and any other site or computer programs belonging to Users

"Collaborator": refers to the User with access to the "collaborator" interface of the Platform

"Manager": refers to the User with access to the "manager" interface of the Platform "Administrator": refers to the User with access to the "administrator" interface of the Platform

"Platform": refers to access to the Objow software from the web link https://app.objow.com or from the mobile application downloadable from the Android and IOS stores, and all associated Services.

"Service(s)": refers to all the functionalities offered by the Platform for Users

"User(s)": refers to the Administrator, Manager and Employee using the Platform Services.

Article 3 - Purpose of the Platform and right of use

3.1 The Platform offers various Services enabling any User to access the management, goal-setting and collaborative management Services presented on the Platform.

3.2 OBJOW authorizes all Users to browse the Platform and to use the various Services, depending on their access limitations. The access limitations to the Services depend on their qualification as Administrator, Manager or Collaborator defined on the Platform. Limitations on access to the Services may change depending on the version of use of the Platform, which the User accepts and acknowledges.

3.3 All Users are granted access to the Services on a non-exclusive, non-transferable, non-modifiable and non-transformable basis and in accordance with the purpose of the Platform and the exclusive purpose of each of the Services, namely :

  • in accordance with the provisions of these GCU;
  • for the User's business needs only;
  • only after subscription and provided the subscription is valid.

3.4 Any use of the Platform or its Services that does not comply with its intended purpose as set out above constitutes a breach of these TOU and entitles OBJOW to restrict or remove access to one or more Users, in particular by deleting their account.

3.5 Users are prohibited from:

  • attempt in any way to modify the settings of the Platform or its Services or to modify their purpose;
  • to process, disseminate, download or transmit by any computer process data that does not belong to a User or to the company to which the Administrator is attached;
  • copy, decompile, lend, rent, sell, market, make available or use the Platform or any part of its Services for the benefit of third parties, in any form whatsoever, whether free of charge or against payment.

Article 4 - Creating a User account

4.1 For access to the Platform by any User, the company to which any User is attached must take out a subscription with OBJOW in accordance with the terms and conditions defined by its general terms and conditions of sale or the SAAS Contract.

4.2 After receiving his access codes, the Administrator creates Users' accesses, defines a default password and invites them to join the platform, recommending that they change their password on first connection. The correct management of passwords is the responsibility of Users, and depends on the security policy defined and communicated by the Customer. Administrators may reset Users' passwords if necessary.
4.3 The Administrator is free to add or delete a User account according to the terms of the Platform, as long as the number of Users added or deleted corresponds to the number of Users in the subscription. If the addition or deletion of Users modifies the subscription band, the Administrator will be invited to contact OBJOW's sales department to modify the subscribed subscription.

4.4 Each User undertakes to provide accurate, up-to-date and complete information, enabling his/her identification in accordance with article 6-II of law n°2004-575 of June 21, 2004 for confidence in the digital economy. In particular, the User undertakes not to create a false identity likely to mislead another User, OBJOW or any third party and not to usurp the identity of another natural or legal person. The User undertakes to immediately update, in the event of any modification, the data he or she has communicated when registering on the Platform.

4.5 In the event that the User provides information that is false, inaccurate, outdated, incomplete, misleading or likely to mislead, OBJOW may, at its sole discretion, without formality, notice or compensation, inform the Administrator, suspend or terminate the User's account and deny access to the Services to any User, temporarily or permanently.

4.7 The User undertakes to keep his identifiers confidential. OBJOW shall not be held liable for the loss of its identifiers. The storage, use and transmission of the User's identifiers are carried out under the User's full and sole responsibility. Any use of identifiers is presumed to have been made or duly authorized by him.

4.8 Apart from the information defined as mandatory for the creation of his account, each User is free to complete his profile according to the information proposals defined by the Platform. The User is solely responsible for the accuracy of any optional information provided. 4.9 By completing his profile photo, the User declares that the photograph represents him and does not violate the property rights of any third party. He/she consents to the published photograph being processed by the Platform and made accessible to all Users for his/her identification.

4.10 By completing any quotation or free heading on the Platform, the User agrees to moderation and refrains from infringing the rights, image or reputation of a third party, another User, OBJOW, its subcontractors or the Platform and in general, refrains from publishing any message contrary to ethics, morality and good manners.

4.11 Information concerning the User can be accessed and modified in the "My info" section and can be consulted by other users from the "teams" tab.

User rights

In accordance with the RGPD, you have the right:

  • Access your personal data and receive a copy of this data.
  • Rectify inaccurate or incomplete data.
  • To delete your personal data in certain circumstances.
  • Limit the processing of your personal data.
  • To the portability of your data, allowing you to receive data in a structured, commonly used and machine-readable format.
  • Oppose the processing of your personal data.

To exercise these rights, please contact us at support@objow.com. We will respond to your request within one month, in accordance with the requirements of the RGPD.

Article 5 - Services offered by the Platform  

5.1 Fixation d’objectifs, de challenge et de défis

5.1.1 La Plateforme propose des Services reposant sur le principe de la « gamification ». La gamification consiste à utiliser des mécanismes de jeux dans un contexte professionnel afin de le rendre plus ludique en créant une émulation auprès des Utilisateurs.

5.1.2 La Plateforme met à la disposition du Manager un Service d’animation, d’échange et de coaching de ses équipes. La constitution des équipes regroupant un ou plusieurs Utilisateurs est définie par le ou les Administrateurs ou Manager.

5.1.3 La Plateforme met également à la disposition du Manager et de l’Administrateur des Services de personnalisation, de suivi d’objectifs, et d’organisation de challenges et de défis à destination des Collaborateurs ou d’une équipe de Collaborateurs, accessibles depuis son espace personnel. Le Manager et/ou l’Administrateur sont seuls responsables de la fixation des objectifs, des challenges, des défis, des et de la désignation du ou des Utilisateurs concernés. La Plateforme se limite à retranscrire les objectifs, challenges et défis fixés par le Manager et/ou l’Administrateur et à déterminer le pourcentage de réalisation d’objectifs ou le classement de chaque Utilisateur ou d’une équipe d’Utilisateur à un challenge. Cette retranscription est réalisée à partir des seules informations communiquées par les Utilisateurs ou par les Connecteurs traitant des données entre la Plateforme et tout autre site ou programmes informatiques utilisés par les Utilisateurs à titre professionnel dans le cadre de ses fonctions. Certains Connecteurs peuvent être modifiés et paramétrés en tout ou partie par les Administrateurs suivant les modalités présentées sur la Plateforme.  

5.1.4 La Plateforme met à la disposition de l’Administrateur un Service de fixation de récompenses des Utilisateurs, par l’octroi de points, suivant les règles d’attribution proposées par la Plateforme ou suivant les règles fixées par l’Administrateur lui-même. L’Administrateur fixe les dotations des points en fonction des objectifs, challenges et défis réalisés par un ou plusieurs Utilisateurs. L’Administrateur est seul responsable de la gestion et de l’équilibre de l’attribution des points, notamment au regard du respect des règles du droit du travail en matière de lutte contre les discriminations et d’égalité des rémunérations. Notamment, lorsque les récompenses sont octroyées de manière pécuniaire, OBJOW informe l’Administrateur que celles-ci sont susceptibles d’être soumises à cotisations sociales obligatoires et facultatives. A ce titre, l’Administrateur est invité à prendre connaissance auprès de son conseil fiscal et/ou comptable des conséquences administratives et financières de l’octroi de récompenses pécuniaires aux Utilisateurs notamment lorsque ceux-ci sont salariés.

5.1.5 Chaque Utilisateur reconnaît et accepte que les pourcentages de réalisation de ses objectifs ou ses classements aux challenges et défis soient accessibles par tous les autres Utilisateurs sur la Plateforme et peuvent avoir des conséquences pour l’octroi ou non de récompenses. OBJOW ne peut être tenue pour responsable des préjudices directs ou indirects ayant prétendument pour origine la perception ou non de récompenses ou l’accès libre à ses informations.  

5.1.6 La Plateforme propose également à chaque Utilisateur un espace de « Coaching List » permettant la détermination et le suivi de taches, d’actions ou de recommandations individuelles déterminées par les Managers. Chaque Utilisateur concerné peut accéder, depuis son espace personnel, à sa « Coaching List » et il lui appartient de la tenir à jour, sans que OBJOW ne puisse garantir la réalité de l’avancement et du suivi de chacune des taches, des actions, des recommandations ou des objectifs. 5.2 Remonté d’informations sur la Plateforme par connecteurs

5.2.1 La Plateforme est susceptible de collecter des données transmises par le Client et/ou l’Administrateur, de retraiter ses données et d’en automatiser le traitement. La saisie des données peut également être effectuée par l’Administrateur au travers de la Plateforme si cela a été défini sur un ou plusieurs Objectifs. Dans les deux cas, OBJOW ne pourra en aucun cas être tenue pour responsable de la pertinence, la véracité ou la mise à jour des données recueillies.

5.2.2 Concernant les données à caractère personnel collectés par la Plateforme, chaque Utilisateur est invité à consulter et accepter la politique de protection des données de OBJOW.

5.2.3 OBJOW s'engage à assurer le bon fonctionnement des Connecteurs mis en place afin de fournir une information juste et réelle diffusée sur la Plateforme. L’Utilisateur reconnait cependant que le fonctionnement de la Plateforme est, dans ce cas, dépendant des données collectées transmises par le client par des technologies développées et exploitées par des tiers ou l’Utilisateur envers lesquelles ne dispose d'aucun moyen de contrôle ou d'intervention. Ainsi, OBJOW ne pourra être tenue pour responsable de traitement de données erronées, de dysfonctionnement ou d’interruption résultant de la Plateforme qui ne lui seraient pas directement imputables, sauf dans l’hypothèse où ces traitements de données, dysfonctionnements et/ou interruptions auraient générés ou accrus du fait de sa propre négligence.

Article 6 - OBJOW intellectual property

6.1 OBJOW is the exclusive owner of the intellectual property rights relating to the Platform. OBJOW is also the sole owner of the technical data automatically uploaded to the Platform or manually uploaded by any User. No stipulation of the present GCU may be interpreted as operating any transfer of intellectual property rights or use of the brand name "le Prestataire" to the benefit of a User.

These GCU also do not include any transfer of ownership of the Platform, its Services or any of their elements (icons, gifs, texts, images and graphics, source codes or object codes, associated documentation, etc.) to a User, which are protected by OBJOW's intellectual property rights. The same applies to any logos, trademarks or content belonging to other companies, whether partners of OBJOW or not, which are present on the Platform. OBJOW is also the sole owner of the intellectual property rights on the Connectors it uses and on the methods of corrective and evolutionary maintenance of the Platform.

6.2 The User undertakes not to decompile, reproduce, translate, adapt, arrange, modify or copy, even as a backup, the Platform or any of its elements, even if such acts would be necessary to allow their use in accordance with their intended purpose.

6.3 The User agrees not to (without this list being limitative): - permanently or temporarily reproducing all or part of the Platform or its Services by any means and in any form, including in connection with any content loading, display or execution, in whole or in part; - adapting, arranging, exporting, separating, assembling or decompiling in any way whatsoever the Platform or its Services, the source codes or object codes of the elements comprising them.

Article 7 - Consequences of deleting a User's account

7.1 In the event of deletion of a User's account, for whatever reason, access to the Services will be immediately interrupted, without formality, notice or compensation for the User concerned.

7.2 The User concerned may request a copy of his/her personal data from OBJOW in accordance with current regulations and OBJOW's data management policy.

Article 8 - Updating the Platform

8.1 The User acknowledges that the Internet network systems required to connect to and browse the Platform are his/her sole responsibility, and depend in particular on his/her equipment. The same applies to access to the "mobile application" version downloadable from the Apple and Google Stores, which may require an update of the application and potentially a change in the equipment used.

8.2 The User acknowledges that OBJOW may remotely update and maintain the Platform.

Article 9 - OBJOW's liability  

9.1 OBJOW SHALL IN NO EVENT BE LIABLE FOR ANY USE OF THE PLATFORM CONTRARY TO THESE GGU, OR IN THE EVENT THAT THE INFORMATION PROVIDED BY A USER WHEN CREATING AN ACCOUNT OR USING THE SERVICES IS INCOMPLETE, INACCURATE OR ERRONEOUS. 9.2 For the execution of article

8.2 above, THE USER ACKNOWLEDGES THAT THE TEMPORARY INACCESSIBILITY AND / OR MALFUNCTION OF THE PLATFORM FOLLOWING OPERATIONS OF UPDATE OR MAINTENANCE CAN NOT CONSTITUTE A DIRECT OR INDIRECT DAMAGE WHEN THE USER IS PREVIOUSLY INFORMED OF THESE OPERATIONS WITHIN A REASONABLE TIME AND EXCEPT IN THE HYPOTHESIS OR THESE MALFUNCTIONS AND / OR INACCESIBILITIES HAVE BEEN GENERATED OR INCREASED DUE TO ITS OWN NEGLIGENCE AND / OR LACK OF DILIGENCE.

9.3 OBJOW undertakes to use its best efforts to ensure the proper functioning and continued access to the Platform. However, it is expressly agreed that the operation of the Platform is partly based on technologies developed and operated by third parties over whom OBJOW has no means of control or intervention. THEREFORE, OBJOW SHALL NOT BE HELD RESPONSIBLE IN THE EVENT OF DYSFUNCTION OR INTERRUPTION OR FAILURE OF THE USER'S INTERNET NETWORK OR FAILURE OF HIS COMPUTER EQUIPMENT, AND MORE GENERALLY IN THE EVENT OF FAILURE OF A THIRD PARTY

9.4 Finally, OBJOW uses technologies to ensure the security of use of the Services and browsing on the Platform. HOWEVER, THE USER ACCEPTS ALL RISKS AND CHARACTERISTICS SPECIFIC TO THE USE OF MEANS OF CONNECTION TO THE INTERNET NETWORKS, IN PARTICULAR POSSIBLE TRANSMISSION DELAYS, TECHNICAL MALFUNCTIONS AND RISKS OF PIRACY, UNLESS THESE RISKS, IN PARTICULAR OF PIRACY, ARE DIRECTLY OR INDIRECTLY ATTRIBUTABLE TO OBJOW OR HAVE BEEN GENERATED AND INCREASED BY ITS OWN NEGLIGENCE, IN PARTICULAR BUT NOT LIMITED TO IF THE PLATFORM AND ASSOCIATED TECHNOLOGIES DO NOT MAKE IT POSSIBLE TO ENSURE SUFFICIENT AND REASONABLE PREVENTION OF THESE RISKS AND THE PRESERVATION OF USER DATA.

Article 10 - Personal data and privacy policy

By using the Platform, all Users acknowledge that they have read and accepted OBJOW's data privacy policy, which is fully applicable to the use of the Platform and can be accessed at the following address: xxx

Article 11 - Applicable law and jurisdiction

11.1 These GCU are governed and interpreted by French law.

11.2 Any dispute relating to these GCU and, more generally, any dispute relating to the use of the Platform or the deletion of a User's account shall be subject to the exclusive jurisdiction of the Lyon Commercial Court, with the exception of disputes concerning non-trading persons, for which the legal rules governing the attribution of jurisdiction apply.
